The present State of Madhya Pradesh, as is well known, was created on 2 November 1861 as the Central Province as a Judicial Commission area and administered by a Judicial Commissioner. The highest court in the region was situated in Nagpur at that time. In 1921, it was elevated to a Governor’s province, making it eligible for a full-fledged High Court. However, due to financial and administrative constraints, the establishment of a High Court was delayed for approximately 15 years. In 1933, Berar, a region of the Nizam’s state of Hyderabad, was merged with the Central Province, leading to its renaming as “Central Provinces & Berar.”

Subsequently, on 2 January 1936, under Section 108 of the Government of India Act, 1915, King-Emperor George the Fifth established the Nagpur High Court for Central Provinces & Berar. The Letters Patent, through which the Nagpur High Court was formed and endowed with jurisdiction, remained effective even after the adoption of the Indian Constitution on 26th January 1950, by Articles 225 & 372.

The States Reorganization Act came into effect on 1 November 1956, leading to the formation of the new state of Madhya Pradesh under Section 9. According to Subsection (1) of Section 49 of the Act, the existing Nagpur High Court was designated as the High Court for the present state of Madhya Pradesh from the appointed day, with its seat in Jabalpur. On 1 November 1956, the Chief Justice established temporary benches of the High Court of Madhya Pradesh in Indore and Gwalior. Subsequently, through a Presidential Notification dated 28 November 1968, permanent benches were instituted in Indore and Gwalior under the powers conferred by Subsection (2) of Section 51 of the States Reorganization Act, 1956.

This arrangement persisted until 1 November 2000, when the state of Chhattisgarh was carved out of Madhya Pradesh by the Madhya Pradesh Reorganization Act, 2000, leading to the establishment of the High Court of Chhattisgarh in Bilaspur. Consequently, the High Court of Madhya Pradesh in Jabalpur became the High Court for the successor state of Madhya Pradesh.
